The Law Behind It: Why Insurers Must Cover Mental Health

  • Copays for psychiatric evaluation cannot be higher than copays for a comparable specialist visit (cardiology, orthopedics, etc.)
  • Annual visit limits for physical health cannot be applied more restrictively to mental health
  • Prior authorization requirements must be applied equivalently — insurers can’t make mental health authorizations harder to get than medical ones

The law applies to most employer-sponsored health plans, individual and small-group marketplace plans, Medicaid managed care, and CHIP. If your plan covers mental health at all, it must cover it at parity.
